In order to encourage the participation of associates in the entity's projects and in the direction of the Brazilian software and services industry, ABES created, in 1995, the Working Groups (GT) that, since 2013, started to use the name of Committees . They function as forums for discussing specific issues related to the sector, presenting proposals and action plans.<\/p>\n

The functioning of the committees is guided by an internal regulation established by the association, which defines the best practices: operation, form of performance, results and reports.<\/p>\n

On a daily basis, committees must be a constant channel of communication between the membership, the Deliberative Council and the Executive Board.<\/p>\n

Committee contributions<\/strong><\/p>\n

Along its trajectory, ABES has already promoted the creation of several Committees, such as: Mercosur \/ Foreign Market, Multimedia, Informatics in Public Schools, Antipiracy, Telecommunications and Tax and Tax Matters. They generated work plans that brought great advances and contributed effectively to reducing companies' operating costs, simplifying the tax framework in Brazil and improving regulation in the sector.<\/p>\n

A great example was the approval of Complementary Law 116, which determined that IT activities should only collect ISS, including the elaboration of computer programs and the licensing or assignment of the right to use software.<\/p>\n

Intellectual Property Committee<\/strong><\/p>\n

The Intellectual Property Committee, formed in 2011, is the result of the union of the \u201cAntipiracy Consumption\u201d and \u201cCorporate Antipiracy\u201d Committees, which aims to defend respect for the intellectual property of software in Brazil.<\/p>\n

Among the activities of this Committee, we highlight the monitoring of anti-piracy operations carried out in the regions with the greatest concentration of the problem, provision of logistical support in the operations carried out by the police authorities, monitoring of the Internet to remove sales advertisements for unlicensed programs, dissemination information on copyright, legislative activity aimed at reducing taxes and promoting educational campaigns.<\/p>\n

Regulatory Committee<\/strong><\/p>\n

Created in June 2014, the Regulatory Committee aims to discuss regulatory issues of national relevance to the technology and software sector, enabling entrepreneurs and their representatives to participate more intensively in debates around laws, policies and government programs that impact the ICT sector. The committee will contribute to the entity's position in favor of a regulatory environment favorable to market development, a role that is part of ABES's mission.<\/p>\n

Among the topics on the Regulatory Committee's agenda are competitiveness, taxation and incentives, regulation of the Marco Civil, Preliminary Project for the Protection of Personal Data and the improvement of the Information Technology Law. The Committee has already played an important role in the preparation of the plan \u201cFor a Digital and Competitive Brazil\u201d, delivered to presidential candidates and candidates for state governments during the 2014 Election campaign and signed by ABES, Assespro and Brasscom.<\/p>\n

Taxation Working Group<\/strong><\/p>\n

Linked to the Regulatory Committee, the idea of creating the Taxation Working Group, formed in July 2015, arose from the identification of a growing concern for tax issues, as well as the need to involve the entity more deeply in the elaboration of projects that aimed at improving the relevant regulatory frameworks for the sector.<\/p>\n

The Taxation WG proposes to study issues related to the taxation of transactions with software and other information technology services, to propose to ABES, through the Regulatory Committee, actions related to the taxation of these activities, in addition to disseminating information, tips or suggestions on the theme for the other associates, a fundamental topic for the good progress of business and the competitiveness of Brazilian companies.<\/p>\n

Data Protection Working Group<\/strong><\/p>\n

The Working Group on LGPD - General Data Protection Law (Law No. 13,709 \/ 2018) was created in December 2018, with the aim of deepening the understanding of the law and promoting the debate on its impacts and challenges for the sector, as well as to discuss proposals regarding the future regulation of the LGPD. Sanctioned in August 2018, the LGPD, which provides for the guarantee of privacy of personal data and clearer rules on the processes of collection, storage and sharing of this information, and should take effect from the second half of 2020. This standard is applicable to all sectors of the economy and provides for severe sanctions, especially in the event of data leakage.<\/p>\n

Digital Technology Committee<\/strong><\/p>\n

Created in August 2019, this committee aims to gather and disseminate knowledge about different digital technologies and local and global trends, stimulating cooperation and articulation between members, public authorities and research centers, aiming at the development of the technology sector. ICT in Brazil. The growth of this sector has a transversal impact on industry, commerce, public management, medicine, agriculture, sports, health and even the domestic environment. This is a broad universe of disruptive technologies, such as: cloud computing, big data, mobility, information security, SaaS, internet of things, artificial intelligence, etc. The committee's debates and actions aim to promote the integration of these technologies, preparing companies to maximize the positive transformations they promote in business, public management and people's quality of life.<\/p>\n

Initiative aims to stimulate the Brazilian Business Intelligence (BI) and Analytics market, which is on the rise, and generate synergistic actions between associated companies. According to the most recent ABES\/IDC studies<\/a>, companies declared that investments in BI, Analytics, Big Data and Artificial Intelligence are on the priority list, opening up an opportunity to bring more relevance to the topic.<\/p>\n

This integration forum should also promote a dialogue between the technology sector, public policy makers, professionals in the area of education and human resources, bearing in mind that it is essential to encourage collaboration between various actors in order to create actions that meet growing demand for technology professionals.<\/p>\n
